Subdivision and Development Appeals

The Subdivision and Development Appeal Board (SDAB) hears appeals related to decisions made by Cardston County’s Subdivision Authority and Development Authority. The SDAB serves as a fair and impartial review body, ensuring that land use and development decisions follow Cardston County’s Land Use Bylaw and the Municipal Government Act (MGA).



What Decisions Can Be Appealed?

The SDAB provides a process for applicants, landowners, and affected parties to challenge:

  • A decision made by the Development Authority on a development permit application.
  • A decision made by the Subdivision Authority on a subdivision application.
  • The issuance of a Stop Order issued by the County to enforce compliance with regulations.


How to File an Appeal

If you disagree with a decision on a development permit or subdivision application or have received a Stop Order, you may file a Notice of Appeal with the appropriate appeal board.



Before Filing an Appeal

We strongly recommend that anyone considering an appeal contact Cardston County or Oldman River Regional Services Commission (ORRSC) to:

✅ Understand the grounds for appeal
✅ Confirm appeal deadlines and requirements
✅ Get assistance with completing the appeal form

This helps ensure your appeal is filed correctly and on time.



Important Timelines

  • Appeals of development permit decisions must be filed within 21 days of the date the decision was issued.
  • Appeals of subdivision decisions must be filed within 14 days of the date the decision was issued.
  • Appeals of a Stop Order must be filed within 14 days of the order being issued.


What Happens After You File an Appeal?

  1. Your appeal will be scheduled for a public hearing before the Subdivision and Development Appeal Board (SDAB).
  2. You will have the opportunity to present your case, provide supporting evidence, and respond to questions from the board.
  3. The board will hear from the applicant, the Development or Subdivision Authority, and any affected parties who wish to speak.
  4. After the hearing, the SDAB will deliberate and issue a written decision.
